These Terms of Service govern your access to the Leopard Fitness website and your purchase, possession, installation, and use of products and services supplied by Leopard Fitness.
Leopard Fitness is an operating name of East to West Co Ltd.
By accessing our website, placing an order, requesting a quotation, purchasing equipment, accepting delivery, or using products supplied by us, you agree to these Terms.
1. Business Identity
Throughout these Terms, “Leopard Fitness,” “East to West Co Ltd.,” “we,” “us,” and “our” refer to East to West Co Ltd., operating as Leopard Fitness.
“You” and “your” refer to customers, purchasers, website visitors, users of our products, and any person using equipment purchased from us.
2. Products and Services
Leopard Fitness sells fitness equipment, strength-training equipment, functional trainers, racks, Smith machines, weights, bars, benches, flooring, accessories, storage products, and related products and services.
Installation, assembly, delivery, commercial consultation, and other services are included only when expressly stated in your order or quotation.
3. Product Information
We make reasonable efforts to ensure product descriptions, photographs, specifications, dimensions, capacities, pricing, and features are accurate.
However, manufacturers may make minor changes to specifications, finishes, components, packaging, or product appearance without notice.
Product images may show accessories or surrounding equipment that are not included unless expressly stated in the product description or package contents.
4. Orders and Availability
All orders are subject to acceptance and product availability.
We may cancel or refuse an order where a product becomes unavailable, an obvious pricing error has occurred, payment cannot be verified, fraudulent activity is suspected, or delivery cannot reasonably be completed.
If we cancel a paid order before fulfillment, the amount paid for the cancelled products or unperformed services will be refunded.
5. Pricing and Payment
Prices are displayed in Canadian dollars unless otherwise stated.
Applicable charges will be displayed or communicated before your purchase is finalized.
Commercial quotations, deposits, payment schedules, and specially negotiated transactions may also be governed by the applicable quotation or invoice.
6. Delivery
Customers are responsible for providing accurate delivery information and ensuring safe and reasonable access to the delivery location.
For large equipment, the customer is responsible for confirming that doorways, hallways, elevators, stairs, flooring, ceiling height, entry routes, and the intended installation area can safely accommodate the equipment.
Additional costs may apply when actual delivery conditions materially differ from the information provided when the order was placed.
7. Installation and Assembly
Installation or assembly is only included where specifically purchased or agreed upon.
Unless expressly stated otherwise, installation does not include building modifications, electrical work, flooring construction, structural reinforcement, wall modification, removal of unrelated equipment, or relocation of equipment after installation.
The customer is responsible for ensuring the intended installation location is structurally appropriate and safe.
8. Assumption of Risk
Fitness equipment and physical exercise involve inherent and foreseeable risks.
These risks include, without limitation, falls, strains, sprains, fractures, crushing injuries, impact injuries, cable or weight-related injuries, equipment movement or tipping, aggravation of medical conditions, cardiovascular events, permanent disability, serious bodily injury, and death.
By purchasing, possessing, installing, accessing, or using equipment supplied by East to West Co Ltd., operating as Leopard Fitness, you knowingly and voluntarily assume the risks associated with the possession and use of that equipment.
You are responsible for determining whether you are physically capable of performing an exercise and whether any particular equipment, resistance level, weight, movement, or training activity is appropriate for you.
Where appropriate, consult a qualified healthcare or fitness professional before beginning an exercise program.
9. Personal Injury and User Responsibility
Use of Leopard Fitness equipment is undertaken at the user's own risk.
You are responsible for using equipment safely, following instructions and warnings, remaining within published capacity limits, inspecting equipment, maintaining equipment, ensuring bolts and fasteners remain secure, and keeping the training area suitable and free from hazards.
You are also responsible for ensuring minors, guests, customers, employees, patients, clients, members, or other individuals using the equipment are appropriately supervised.
East to West Co Ltd. is not responsible for injury resulting from misuse, overloading, improper exercise technique, improper installation not performed by us, unauthorized modification, inadequate maintenance, unsafe surroundings, ignoring warnings, or use contrary to the intended purpose of the product.
10. Release and Waiver of Liability
To the fullest extent permitted by applicable law, by purchasing or using products supplied by East to West Co Ltd., operating as Leopard Fitness, you voluntarily assume the risks associated with their possession and use.
You agree to release and hold harmless East to West Co Ltd., operating as Leopard Fitness, together with its directors, officers, owners, employees, contractors, installers, representatives, agents, affiliates, and suppliers, from claims, demands, damages, losses, expenses, or causes of action arising from injury, illness, disability, death, property damage, or other loss arising from the use, misuse, installation, movement, maintenance, modification, or possession of the equipment, except to the extent that such liability cannot legally be excluded or limited.
Nothing in these Terms is intended to exclude any liability or consumer right that cannot legally be excluded under applicable law.
11. No Medical or Fitness Advice
Leopard Fitness supplies fitness equipment.
We do not provide medical, physiotherapy, rehabilitation, chiropractic, personal training, or healthcare advice unless explicitly provided by an appropriately qualified professional under a separate agreement.
No content on our website should be interpreted as medical advice.
We do not guarantee any specific strength, weight-loss, rehabilitation, athletic, health, or fitness result from use of our products.
12. Equipment Maintenance
The purchaser is responsible for ongoing inspection and maintenance after delivery.
Equipment should not be used if any component appears damaged, loose, excessively worn, unstable, or otherwise unsafe.
Any suspected safety issue should be addressed before further use.
13. Warranty
Products may include product-specific or manufacturer warranties.
Warranty coverage does not ordinarily apply to normal wear, cosmetic damage, abuse, misuse, exceeding published capacities, corrosion caused by unsuitable environments, unauthorized modification, improper maintenance, improper installation, accidents, or damage resulting from moving equipment.
Product-specific warranty terms prevail where they differ from these general Terms.
14. Returns
Returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.
15. Commercial Use
Equipment purchased for gyms, studios, clinics, rehabilitation facilities, workplaces, condominiums, athletic facilities, schools, commercial facilities, or other organizations must be operated under appropriate safety, supervision, inspection, and maintenance procedures.
The commercial purchaser is responsible for its employees, customers, patients, clients, members, guests, and other equipment users.
16. Limitation of Liability
To the fullest extent permitted by law, East to West Co Ltd., operating as Leopard Fitness, and its directors, officers, owners, employees, contractors, representatives, agents, affiliates, and suppliers will not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages arising from the purchase, possession, installation, assembly, use, misuse, maintenance, movement, modification, or inability to use our products.
This includes, without limitation, personal injury, property damage, loss of income, loss of business, loss of profits, business interruption, loss of use, or consequential financial loss, except to the extent such liability cannot lawfully be excluded.
17. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless East to West Co Ltd., operating as Leopard Fitness, from claims, liabilities, losses, damages, costs, or reasonable legal expenses arising from your misuse of equipment, unauthorized modification, failure to follow instructions or warnings, improper installation not performed by us, failure to maintain equipment, exceeding published equipment capacities, or violation of these Terms.
18. Intellectual Property
Leopard Fitness branding, product presentations, written content, graphics, photographs, videos, layouts, logos, and other original website materials are owned by East to West Co Ltd. or used with permission.
They may not be reproduced or commercially exploited without authorization.
19. Third-Party Services
Our store may use Shopify and other third-party providers for ecommerce, payment processing, financing, analytics, advertising, delivery, and other services.
Certain third-party services may be governed by separate terms and privacy policies.
20. Privacy
Personal information is handled in accordance with our Privacy Policy.
21. Governing Law
These Terms are governed by the applicable laws of Alberta and Canada, subject to any mandatory consumer rights that cannot lawfully be excluded.
22. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
23. Changes
We may update these Terms periodically.
The current version will be published on our website with the applicable last-updated date.
